Trusts, Gifts and Estates term paper (ANY TOPIC) Essay

Trusts, Gifts and Estates term paper (ANY TOPIC) - Essay Example This results to the preservation of a harmonious familial relationship and the achievement of several financial benefits such as the creation of cash reserves and the after-tax income available. According to Brown and Myers (2008), it is important to underscore that the primary objective of all family estate planning is to provide psychological and financial security by obtaining â€Å"the maximum benefits of principal and income for the family and to pass on the family property intact (i.e. without losses)† (23). The last will and testament is an excellent example of estate planning and administration. There is also the case the revocable living trust. Both of these are popular choices for people seeking to manage and administer their assets and properties. This paper will explore why the revocable living trust can prove to be more beneficial for everyone than the last will and testament. Background The last will and testament or more generally known as the will is a legal do cument that provides the disposition of assets and properties. Simply put, in case of death, the ownership of a property is transferred according to the terms of the will of the deceased, the terms that document his desires particularly in the distribution of his estate and assets (Wardle and Nolan, 1042). Gau (2004) provided another definition, which states that it is â€Å"an expression of a person’s wishes for the disposition of property and the protection of loved ones at the time of the maker’s death† (7). The US legal framework considers the use of will as a developmental offshoot of basic estate planning, that one with the simple goal of planning for death (Wardle and Nolan, 1039-1043). It was further provided that the impetus for the development of wills was the need for federal estate tax planning for death and lifetime transfers (1039-1040). Baker wrote that the key is to keep it up to date because a clearly defined will could be the best piece of lega l work that one could have that can be used to honor one’s wishes and in defining the family’s futures (52). She also stressed that the will is a reliable backup to a trust in the estate planning process, in addition to several conditions, which she has listed such as: The fact that there are properties that are better left in a will; Money such as lottery winning can be distributed after death through a will and as a component of an estate plan; Parents with minor children. The will can name the guardian and the administrator of assets and properties before the children reach legal age; The appointment of an executor; and Disinheriting a person (Baker, 53-54). There are many other instances where the will is indispensable. It is important for people interested to draft their own wills to consult an estate planning professional or an estate planning team. The process may be simple, but there is a requirement to be thorough, clear and detailed so that the documented wou ld not be invalidated, contested and misinterpreted. It is also important to highlight that if assets are to be transferred through a will, the maker is necessarily deceased. The utility of the will as explained in this section does not mean that there are no other alternatives. There are several others that people prefer because it is more beneficial or that it is aligned with their own estate planning objectives. The Revocable Living Trust

Individual project 3 Essay Example | Topics and Well Written Essays - 1250 words

Individual project 3 - Essay Example There are two types of Currency Markets; Spot Market is basically a market where immediate transactions take place. Once the transactions are made, they are recorded by the 2nd business day. The main participants by market include brokers commercial banks customers of commercial and central banks Sources of spot quotations come from all major newspapers and major currencies that use different quotes. The spot market has varying prices depending on the number of days from say 30-day through 60-day to 180-day. The spot market recognizes the customers even when making quotations. The costs of Transactions Costs will depend on the market trends as well as a bid-spread basis. This helps us to formulate the spot as well as forward exchange rates. The bid represents the price or cost at which the bidder (mostly bank) is willing to buy while the ask equals to the price at which the bidder will sell the currency bought. The other type of currency market is the forward Market. In this form of currency market, transactions take place only at a specified future date or time. It is characterized by ; arbitrageurs traders hedgers speculators The forward market forms’ main aim is to among other things reduce the cost of trading and provide liquidity. It also serves to threaten people mainly traders of oligopoly of information. This form of currency market is more popular that the former as it boasts of a large market size. For instance, the market a trend in a research done annually in 1995 and that on a daily basis in some major cities is as below. 1995: $1.2 trillion dailyMarket Centers (1995) London =$464 billion New York= $244 billion Tokyo = $161 billion In order to effectively handle the assignment, I have broken it down as below so that it is easier to follow through. To calculate the spot and 12-month forward exchange rates we will first to calculate the PS for both German and China currencies. USA German Revenues forecast =$500 million operations=â‚ ¬100 mi llion Operations=$300million ROS= 12% ROS= 10%= net income China Operations=650 million yuan ROS= 8% This can be done by following a formula given below. 1. 10% of $300=$30 PS= {ask-bid}/ask*100 PS= ({$300-$30}/$300)*100 = $90miliion 2. 12% of â‚ ¬100= â‚ ¬12 PS= {ask-bid}/ask*100 PS= ({â‚ ¬100-â‚ ¬12}/â‚ ¬100)*100 =â‚ ¬88million 3. 8% 650 million yuan= 52 million yuan PS= {ask-bid}/ask*100 = {650-52/650}*100 =92 million yuan The forward exchange rate for German will be 90/88 or $1.0227. Whereas, the forward exchange rate for China will be 90/92 or $0.978. Repatriation can be termed as the process of changing a foreign currency into that of an owner’s country. This is usually dependent on the exchange rate between the two currencies caused by disparities between the economies of scale. A good example would be a South African converting American pound back into South African rand so that they are able to use it. While exchanging the money, the trader will be exposed to something called foreign exchange risk. This is when the trader decides to engage in a foreign exchange swap. In a spot transaction, the condition is that of a bid-ask condition. Therefore, depending on how much the bidder (bank) is willing to offer and how much it will sell then the trader will decide whether to be involved in the transaction. So for instance if the bank is in need of the currency, the trader might actually make a profit out of it(Sellon, 1998, 147-177). In the outright forward repatriation,

Globalisation , the World Economy and MNEs Essay - 2

Globalisation , the World Economy and MNEs - Essay Example The government of the will be left fighting to retain its power. The monopolizing effect and lack of local industries will eventually draw the economy into a foreign driven system where the country will depend on the decisions made by these foreign MNEs (Dicken 123). The other disadvantageous effect of foreign investments is felt on the country’s Balance of Payment. As the MNE invest on the country’s economy, they bring in initial capital that will boost the country’s economy, but the earnings from these investments always go back to their parent country (Hill 240). Taxation is also mostly done on the parent country level, meaning that the country does not gain anything from these investments. Another effect is on the importation sector, the main offices of these MNEs are on the parent country and the foreign subsidiary receives their goods from the main office (Rojec 204). This means that the host country will end up being importers, which debits their current accounts of the balance of payment. National sovereignty of the host country and its autonomy also faces some challenges. The MNEs will be on the forefront on the decisions affecting the economy, basing that their major interest is to maximize profit, they would not have much concerns with the economy of the host country. They would make decisions on what is best for them leading to uneven development in the country (Saggi 54). The effort of the country’s government to still retain the decision making control on its economy will not help because they have no control over the foreign

Employee resourcing, talent management, HRD and the skills agenda Essay

Employee resourcing, talent management, HRD and the skills agenda - Essay Example Social media, on the other hand, has mostly integrated into most internet users’ personal lives. Content and information sharing has taken a new shape where each individual can directly broadcast to his whole social circle over the internet. Businesses targeting this type of internet audience develop a whole new set of marketing strategies which involve content sharing giving the customers something to share about the business to their social circles. This implies the advent of social media has morphed business marketing. This directly influences the human resources as well. Where marketing is being morphed by the era of sharing and collaboration, human resource management is also being driven by networked employees that directly share business related information with each other. Such professional networks make it possible for the human resource developers and managements to search for, hire, and evaluate employees over the internet as well as establish continuous professiona l communications to directly manage them over the internet. This allows the degree of freedom to the employees giving them the space to manage themselves and takes this load off the company; essentially being workforce empowering and power delegation. The industries, to compete with the ever expanding businesses and to cater for the ever expanding market, change and improve continuously. Human resourcing in such conditions is, at best, a task for those who understand personalities and roles in field specific tasks and can find such people efficiently.

Report on British Airways Case Study Example | Topics and Well Written Essays - 2000 words

Report on British Airways - Case Study Example The oneworld members work on bilateral basis. They have code sharing and marketing alliances (BA fact book 2007). They sell tickets of one another offering more destinations to their passengers. The group eventually grew to eight members and 23 affiliates by 2001, and collectively served more than 200 million passengers in 133 countries with 566 destinations. Besides, BA has two fully owned subsidiaries also. These are BA Cityflyer which flies from London city airport to all destinations in Europe and Openskies flies to Europe and New York BA is a public company with 43,501 employees and an employee growth of 12.9% annually. The sales in financial year ending in March 2007 was $16,663.0M with annual increase of 12.5% and net income was $596.5M showing a growth of 131.7%. Martin F. Broughton is currently the chairman and Willie Walsh is the chief executive. The finances of BA are managed by Air Cargo Services. (answers.com; britishairways.com ). BA, though made a public Limited Company in 1985 but its stocks were retained by the government till these could be offered to the public. The opposition to privatization was opposed on the grounds of its huge debts and also by British Caledonian stating BA too large to compete with. 1. The ability to carry out expansion plans successfully received a blow when chaos occurred at Heathrow terminal 5 opening. Hundreds of flights were cancelled and thousands of bags lost. The staff was not trained to handle the new baggage handling system and software too did not work well. Later Willie tried to compensate somewhat for the debacle by surrendering his bonus. Nevertheless, it exposed the shortcomings of the expansion plan or may be the haste. Though, there was an apology from Willie Walsh, BA passengers are not going to forget or forgive the debacle for quite sometime (Webster 2008). 1. Staff survey in 1992, rated BA as poor employer despite the HRM initiatives. The staff stated that BA attracts, retains and develops committed employees (Hofpl 1992; Lundy & Cowling 1996 as cited in McCourt & Eldridge 2003: 37). 2. In mid-1997 BA faced a damaging strike due to its attempt to impose new payscales without negotiations with the employees (Walich, 1997 as cited in McCourt & Eldridge 2003). 3. Recently, in 2007 nearly 4500 ground staff refused to accept the pension plan and went on strike. They stated disparity between ground staff and cabin crew options. (Guardian 2007). 4. The environmental issues are also getting bigger everyday with people vowing to cut down on air travel for environmental safety. There are campaigns by Greenpeace and other organisations that aviation companies are not considering enough for environmental protection. BA is likely to lose more on this ground than other UK airlines (Timesonline 2008). The environmental and noise pollution issues raised protests on expansion plans of Heathrow airport to increase its passenger capacity. The chairman replied to Greenpeace that upgradation is good for environment since the queuing up of planes would be reduced and so the climate change gas emission (BBC News Channel, 2007). The organisation constantly undergoes reorganisation and resizing to be flexible and adaptive to changing customer and the staff has to mould. To help staff adapt itself to change, the

How will this affect the performance of the proposed solar water heaters (If you live in an apartment with a flat roof I guess you'll have to pretend that you live on the top floor!) Would there be any practical limitations to the installation of a SWH system. On the roof, the best part would be dependent on two factors: first, it has to be near or at the center part of the roof so that more amount of sunlight falls on the SWH for a longer period of time (from dawn to dusk). Second, it has to be at a requisite to keep it out of reach from children. Using your own house as an example estimate how much hot water your family consumes each year. (As a rough estimate determine how many showers, baths, and basins of hot water are used per week and make a pro-rata calculation for the annual hot water consumption. Remember that most hot water used would be mixed with the cold water. It's not important to be 100% accurate but this will give you an idea of the magnitude of the hot water usage. Average European hot water usage is currently in the range of 15-35 liters of hot water per person per day depending on if you shower or bath!) 4.

Federal Sentencing Guidelines Essay Example | Topics and Well Written Essays - 750 words

Federal Sentencing Guidelines - Essay Example Judges are allowed to sentence aside from the sentencing guidelines with an appropriate reason. In this case, other judges keep a sonorous glance on the sentencing if they are reasonable and appropriate. The basic objective to compile these sentencing guidelines manual is to immobilize crime and to augment the crime justice system giving the reasonable and efficient punishments. The first issue that congress wants to achieve by these sentencing guidelines is honesty. Congress want nation justice to punish criminal in a manner they can not only decrease the crime but also no favoritism may take a part and though, these guidelines help the criminal by lessen their punishment in good if they start doing well for the nation legally. The United States Commission also wants to have a uniform sentencing through out the nation. I.e., Every Federal Court sentence a crime in the same manner as it is treated on the other end of the nation. This may keep the criminal intact that they will be punished with the same sentence wherever they run. Third was the proportionality that is justified punishment that is not to impose a strict rule of act on a small amiss deed or furnish with an act of punis hment that is very least to the crime criminal ended with. There was an interaction with the crim... This person helps the nation catch the criminals red handed while making crimes. The advantage of this to the criminal that the years of chastisement can be reduce and the criminal can promise himself for staying the good man forever and always help the nation to save it from the criminals and terrorists. Castillo's attorney is confident enough for Castillo to receive a favorable consideration from the federal judges while final sentencing. This is only due to his study upon United States Sentencing Commission Guideline Manual, which is actually made for the uniformity of sentencing all over the States and open punishments for nation's knowledge. This strong belief of Castillo's attorney made us study the latest sentencing guideline manual easily available on Internet. The belief of Attorney that Castillo will receive a favorable deliberation from the judges is due to Federal Sentencing Guideline Manual. This manual about drugs visibly imposes the acts 2B1.1with the offence level 6; if the drugs are only steroids but not carrying any more vigorous acting ingredient. The act 2D1.1 may also force upon the criminal if the one is under age i.e., less than 18 (offence level = 26) or (offence level =13) otherwise. Similarly, it is declared that a criminal gets involve in a crime such that a history gets maintained that "Offence Saturatory Maximum" will lead that says that if the criminal get caught for drug supply once with no prior history may punish for ten to twenty years but if his criminal act is upon a history of same acts may implies him with the punishment for thirty years, the maximum rather than twenty years. A departure below the limit can be done if criminal's
